Privacy Notice
This privacy notice describes how we collect and use personal information about you during and after your working relationship with us, in accordance with the General Data Protection Regulation (GDPR). It applies to candidates for employment or engagement with our clients and contacts within our clients’ businesses.

Wendy de Hallé is “data controller” for Marshall Human Resources.
This means that she is responsible for deciding how we hold and use personal information about you. We are required under data protection legislation to notify you of the information contained in this privacy notice.

Data Protection Principles
We will comply with data protection law, which says that the personal information we hold about you must be:

  • Used lawfully, fairly and in a transparent way.
  • Collected only for valid purposes that we have clearly explained to you.
  • Relevant to the purposes we have told you about and limited only to those purposes.
  • Kept only as long as necessary for the purposes we have told you about.

The kind of information we hold about you: 

If you are a candidate we will collect, store and use the following categories of personal information:

  • Personal contact details such as name, title, addresses, telephone numbers, and email addresses.
  • Gender, marital status and dependants.
  • Recruitment information (including copies of right to work documentation, references, work history and other information included in a CV or cover letter or as part of the application process).
  • Any background information about your career history, remuneration, career aspirations and personal circumstances which you provide to us during the course of your dealings with us.
  • Details of any interviews which you have attended and our clients’ feedback on those interviews.
  • Placement records (including job titles, work history, working hours, etc.

If you are a contact we will collect, store and use the following categories of personal information:

  • Personal contact details such as name, job title, addresses, telephone numbers, and email addresses.
  • Any background information relating to your personal circumstances, your work history and the role which you perform within the client organisation which you may provide to us during the course of your dealings with us.

How is your personal information collected? 

If you are a candidate, we collect your personal information through the application and recruitment process, either directly, from referrals, from third party networking sites such as LinkedIn and from job boards, we may also collect additional information from third parties including former employers.

If you are a contact, we will collect personal information directly from you or our client.

How we will use information about you: 

  • Where we need to undertake the contract that we have entered into with you.
  • Where we need to comply with a legal obligation.
  • Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests.

If you are a candidate, we need your personal information to:

  • Provide work-finding services to you and to enable us to comply with legal obligations.
  • Making a decision about your application for employment or engagement with a client organisation.
  • Informing you of opportunities to match the criteria you have outlined to us.

If you are a contact, we need your personal information to:

  • Develop and manage our relationship and to enable us to comply with legal obligations.
  • Maintaining contact to ascertain your hiring needs.
  • Administering and managing any ongoing recruitment services which we are providing.
  • Obtaining interview feedback and references on candidates.

Will we share or sell your data for marketing purposes?
We will not pass your data to any third party for marketing purposes.

Data security and confidentiality
It is our policy to ensure, in so far as is reasonably practicable, that our systems and records are secure and not accessible to unauthorised third parties.

Data retention
We will only retain your personal information for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements.

Data transfer
In the event of a sale, merger, liquidation, receivership or the transfer of our assets to a third party, we may need to transfer your information to a third party. Any transfer will be subject to the agreement of the third party to this Privacy Notice and any processing being in accordance with this Privacy Notice.

Rights of access, correction and removal
It is important that the personal information we hold about you is accurate and current. Please keep us informed if your personal information changes during your working relationship with us.

Your rights in connection with personal information
You have the right to:Request access to your personal information we hold about you and to check that we are lawfully processing it.

  • Request correction of the personal information that we hold about you.
  • Request removal of your personal information where there is no good reason for us continuing to process it.

Taking matters further
If you are unhappy with the manner in which we process your personal data or otherwise observe your data privacy rights, you have the right to complain to the Information Commissioners Office, which the supervisory authority in the United Kingdom.
